The Finnish group, now specializing in network core equipment and mobile technologies, is in fact on trial against Oppo and OnePlus accused of using its 5G and 4G technology protected by patents. German justice has just ruled in favor of Nokia and has therefore ordered the withdrawal of Oppo and OnePlus smartphones from sale throughout Germany.
OnePlus and Oppo violated patents owned by Nokia
The problem is that the story is unlikely to end there. Indeed, other procedures have been launched against Oppo and OnePlus in other European countries for the same reason. The trademarks concerned can nevertheless avoid damage “in theory” – if the holder of the patents concerned (Nokia) accepts a posteriori the payment of royalties on the intellectual properties used.
Which immediately seems more complicated and costly in such a contentious posture. Still, the court decision in Germany now threatens the presence of Oppo and OnePlus in other European countries such as France. The courts can indeed rely on the German decision to decree similar prohibition measures. Enough to deal a blow to the plans of the two brands on the old continent.
A suspension of sales extended to the whole of Europe would be a very bad signal, especially since Oppo and OnePlus products are very popular there. It is therefore easy to imagine to what extent the two brands of BBK have every interest in quickly finding a remedy to this threat.
It should be noted in passing that the German court decision only affects sales of 5G and 4G Oppo and OnePlus smartphones – and not sales of services and accessories. In addition, Oppo and OnePlus 5G smartphones in circulation can continue to hook 5G and operate normally.
Following the publication of this article, Oppo gave us this official reaction:
“As the owner of numerous 5G patents, OPPO values the role of intellectual property in innovation. We are accustomed to establishing cross-licensing agreements with many leading companies and are committed to promoting a healthy intellectual property ecosystem. The day after OPPO and Nokia’s 4G contract expired, Nokia immediately took legal action after demanding an unreasonably high renewal fee.

Our long-term commitment to the German market remains the same and we are working proactively with affected parties to resolve the ongoing issue. Apart from the temporary suspension of sales and marketing of affected products through OPPO-owned channels, OPPO will continue to operate in Germany. During this time, users can continue to use OPPO products, access after-sales services, receive future OS updates, and more.”
