In April, the Biden administration passed a law that will ban TikTok from the United States, unless its owner, the Chinese company ByteDance, decides to sell the social network. And, given that no sales plans have been announced, and that the legal actions taken by the platform have not been successful, TikTok could therefore be banned in the United States from January 19.

But as a new administration prepares its arrival at the White House, the social network has just filed a request for an emergency injunction to prevent the application of the ban on TikTok on January 19. The social network’s main argument is that enforcement of the law should only take place after its appeal has been processed by the United States Supreme Court. But beyond that, the social network also argues that the application of this ban should wait for the arrival of Donald Trump at the White House.

“I will save TikTok”

(…) the Supreme Court should have the opportunity, as the sole appellate court for this action, to decide whether it should review this exceptionally important case. An injunction is all the more appropriate because it will give the incoming administration time to determine its position, which could negate both the impending harm and the need for Supreme Court review”, reads the application filed by TikTok.

Further, he quotes President Donald Trump who, during his campaign, posted a video in which he declared: “I’m going to save TikTok.” In addition to this, in its press release, TikTok also mentions economic arguments. Indeed, according to this, SMEs that use TikTok could lose $1 billion in revenue. And creators could lose nearly $300 million in one month due to TikTok being banned.
