Google has just been sentenced this Wednesday, November 6 to 2,000 euros in damages for having dereferenced pornographic videos too late, according to an order from the Paris judicial court.
A reaction deemed too slow by Google
The complainant, who wishes to remain anonymous, is also a civil party in the French Bukkake affair, the name of the pornographic site closed due to accusations against these administrators. The latter are notably indicted for gang rape and aggravated pimping, recalls The Parisian.
In this separate procedure, French justice considered that the reaction of the search engine, which took place several months after the request, was not prompt enough. It therefore does not comply with the Digital Services Act (DSA), the regulations in force within the European Union.
Google has not yet reacted to this decision. Céline Piques, spokesperson for the association Dare Feminism!, for her part welcomed: “This is an extremely important victory that brings Google face to face with its responsibilities”.
According to The Worldthe plaintiff, like Google, could appeal. Indeed, a big problem remains: copies of original videos which reappear quickly after their dereference. This is a scourge for the victims of this affair who are unable to completely eliminate this content.
A challenge for the main file
As Céline Piques explained to our colleague: “It’s a continuation of the initial harm which is rape, it destroys them from the inside and Google’s responsibility at this level is enormous”. This is also an issue for the upcoming main trial in the French Bukkake case.
She thus emphasizes: “How can we imagine that they manage to go to court with the whole of France watching these videos? In my opinion, this trial will have as significant an impact as that of the Mazan rapes. But this time, the debate on “should we watch the videos in court or not?” will not take place. Because in this case, all the videos are still online. »
As a reminder, the main case is still under investigation. 17 men, who participated in the production and distribution of this pornographic content between 2013 and 2019, are being prosecuted. In front of them, around forty of their victims, whose tortures were broadcast in these videos which are still present online.
